Summary of Key Principles
1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an agricultural entity, cooperative, or forestry enterprise (“User”, “you”), and Msitu Smart Tanzania(“Company”, “we”, “us”, or “our”), concerning your access to and use of the Msitu Smart web application and any associated services (the “Platform”).
By registering an account or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with all of these Terms, you are explicitly prohibited from using the Platform and must discontinue use immediately.
2. Forestry Monitoring Services & Platform Scope
Msitu Smart provides a software-as-a-service suite engineered for forestry farmers, woodlot growers, and timber cooperatives across Tanzania, including Iringa, Njombe, Mbeya, and neighboring regions. Features include:
- GPS Farm Boundary Mapping: Plotting polygon coordinates using satellite map layers to calculate approximate acreage and perimeter.
- Silvicultural Logs & Monitoring: Documenting pruning, thinning, firebreak creation, pest detection, and seedling survival counts.
- Timber Species Registry: Tracking stands of Pinus patula, Eucalyptus grandis, Cypress, Teak, and indigenous species.
- Administrative Verification: Manual payment auditing and stakeholder progress tracking.
3. Land Title & Cadastral Survey Disclaimer
You represent and warrant that you hold legitimate ownership, tenancy, or community management authority over any land parcel or forestry stand you map on the Platform.
4. User Accounts, Security & Accuracy
To access forestry dashboard features, you must register an account by providing accurate, current, and complete information (including legal name, contact email, and general district location). You are responsible for safeguarding your login credentials and for all activities that occur under your account.
You agree to notify us immediately at security@msitusmart.co.tz upon discovering any unauthorized use of your credentials.
5. Subscription Plans, Mobile Money & Manual Verification
Msitu Smart provides both free introductory access and premium subscription tiers (including Standard Tree Grower, Commercial Woodlot, and Cooperative Enterprise plans).
- Accepted Tanzanian Payment Channels: Payments may be remitted via Vodacom M-Pesa, Airtel Money, Tigo Pesa, Halopesa, CRDB Bank, or NMB Bank transfer.
- Manual Verification Protocol: Because payments in Tanzania are frequently conducted via direct mobile money till/paybill or bank deposit slips, all transaction references submitted are reviewed and verified manually by our administrative accounting desk before access is unlocked.
- Pricing & Currency: All subscription tariffs are stated in Tanzanian Shillings (TZS) inclusive of applicable statutory taxes unless stated otherwise.
- Refunds: Once a forestry plot has been activated and boundary data processed on our high-resolution GIS layer, subscription payments are non-refundable except where required under Tanzanian consumer protection legislation.
6. Intellectual Property & User Data
Your Data: You retain complete ownership of all forestry records, farm photographs, field observation logs, and notes uploaded to your account. You grant Msitu Smart a non-exclusive, royalty-free license to store, process, and display this information solely to deliver the service to you.
Platform Property: The software, code, algorithms, GIS interfaces, trademarks, visual logos, and documentation comprising Msitu Smart remain the exclusive intellectual property of Msitu Smart Tanzania.
7. Prohibited Uses
You agree not to use the Platform to:
- Register or claim forest plots belonging to gazetted national reserves, TFS sanctuaries, or third parties without authorization.
- Falsify carbon monitoring or tree census metrics for fraudulent environmental compensation claims.
- Upload malicious code, exploit API endpoints, or probe unauthorized administrative routes.
- Scrape or reverse engineer platform boundary polygons or proprietary tree inventory algorithms.
8. Limitation of Liability
To the fullest extent permitted by Tanzanian law, Msitu Smart and its officers shall not be liable for any indirect, incidental, or consequential damages resulting from environmental hazards, forest fires, drought, pest outbreaks (such as pine aphids or eucalyptus borers), illegal timber poaching, or GPS satellite signal inaccuracies in remote rural topography.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any legal action or dispute arising out of these Terms shall be resolved amicably through mutual mediation, failing which proceedings shall be submitted to the competent courts located in the Iringa or Dar es Salaam judicial registry.
